Terms and Conditions

1. Entry. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. The Giveaway begins at 12:00:01 a.m. CT on 1/20/2020 and ends at 11:59:59 p.m. CT on 2/29/2020. You may enter the Giveaway by liking and sharing our Facebook Giveaway post then visiting us at 15802 Wayzata Boulevard, Minnetonka, MN 55391 to complete your entry by entering your name and email address on the entry form. Any entries that are not filled out or submitted correctly and completely may be disqualified. Entries will only be accepted as noted above. All entries become the property of BMW of Minnetonka and will not be acknowledged or returned. BMW of Minnetonka may terminate the Giveaway at any time and without notice.
2. Eligibility. You must be a legal resident of the United States and at least 21 years of age and provide valid state identification or driver’s license to enter and win. Employees and representatives of BMW of Minnetonka, and their immediate family members are not eligible for entry. The Giveaway is void where prohibited or restricted by law, and is subject to applicable federal, state, and local laws and regulations. Entrants are limited to one (1) entry. Mechanically altered or reproduced entries are not eligible. The Giveaway is not transferable to another person.
3. Drawing. One (1) winning entry will be drawn on or about 2/29/2020. Subject to the eligibility requirements of these Official Rules, the person(s) whose name is drawn will be awarded the prize. Participants need not be present to win. By entering the Giveaway, you consent to being notified publicly through email from BMW of Minnetonka. You also agree to provide your mailing address and home address to BMW of Minnetonka in order to fulfill your prize. If any winner fails to respond to notification within five (5) business days, the prize will be forfeited and another winner will be randomly selected.
4. Winner Affidavit of Eligibility & Release. Before receiving the prize and as a condition of receiving the prize, winner may be required sign an Affidavit of Eligibility & Release supplied by BMW of Minnetonka which, among other disclaimers: (a) releases BMW of Minnetonka and its subsidiaries, directors, agents, agencies, affiliates, promoters, officers, directors, employees and related persons from any and all liability related to this Giveaway and the receipt and use of the prize; and (b) grants BMW of Minnetonka the right to publish the winner’s name, photograph, testimonial, or other likeness and/or prize information or personal exposition, and or any edited portion thereof, for promotional, advertising and/or publicity purposes in any media, without compensation or notice to, or further consent of, the winner to the extent permitted by law. Winner must complete, sign and return the notarized affidavit of eligibility and release to BMW of Minnetonka before taking delivery of prize. Failure to do so will result in disqualification, forfeiture of the prize and selection of an alternate winner.
5. Odds. The odds of winning depend upon the number of entries received.
6. Prizes. The Giveaway prize is a three (3) night stay in Palm Springs, CA for two (2) individuals, round trip airfare for two (2) individuals and a one (1) day pass to the BMW Performance Driving School in Thermal, CA for two (2) individuals. Prize is non-refundable, non-transferable, and subject to all other terms and conditions of BMW of Minnetonka. Winner shall be responsible for all other fees, taxes, surcharges, or any other incidental costs.
7. Release. By entering the Giveaway, each participant agrees to follow these Official Rules and to release, discharge, and hold harmless BMW of Minnetonka, their respective affiliates, subsidiaries, agents, together with the present and future employees and representatives of each of them, from any and all responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the awarding, receipt, acceptance, use and/or misuse of any prize provided pursuant to the Giveaway and/or any person’s participation in the Giveaway.
8. General. All interpretations of these Official Rules shall be made by BMW of Minnetonka, whose decisions and interpretations shall be final and binding. BMW of Minnetonka reserves the right to cancel, terminate or suspend this Giveaway or any part of this Giveaway for any reason. BMW of Minnetonka reserves the right, at its sole discretion, to disqualify any individual it reasonably suspects or believes to be acting in violation of these rules. BMW of Minnetonka shall not be responsible for lost, incomplete, misdirected, misdelivered, misplaced, stolen, illegible, mutilated or defaced entries or for entries that are not received by BMW of Minnetonka for any reason. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant(s) or BMW of Minnetonka in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of Minnesota. In addition, any dispute relating to the Giveaway (including these Official Rules) shall be brought in the appropriate state or federal court having jurisdiction over the subject matter located in Hennepin County, State of Minnesota. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non convenience or lack of personal jurisdiction that they may have.
